On encouraging sterilization
The buyer's attention is drawn to the need to sterilize their cat to avoid possible nuisances linked to the female's heat or markings in the male as well as unwanted protrusion in the exceptional case of an unsupervised release which is strongly discouraged for this type of breed.
In order to protect this breed against all deviances, the seller undertakes from now on (for kittens sold at 12 weeks and over €1,200) to reimburse the lump sum of €55 for the castration of a male or €75 for the sterilization of a female carried out by the buyer's veterinarian upon presentation of supporting documents with the veterinarian's stamp affixed to an identification sticker provided that this intervention takes place before 6 months of the birth of the kitten and which is sent no later than 5 working days from his 6 month birthday.
In the event that the buyer decides not to sterilize his kitten to breed it, he is advised
pay attention to the existence of the order of October 7, 2015 from the Ministry of Agriculture clearly specifying that all sellers of a LOOF domestic animal from a litter that they gave birth to must be in possession of a number siren registered in the agricultural chamber or for a maximum of one litter per year, must first obtain a litter number issued by the LOOF which it will indicate in all sales advertisements. Failure to possess it is punishable by a fine of €7,500! It is also not possible for an individual to sell non-LOOF pets.
The laws in force, which are constantly evolving, rightly protect the interests of the buyer against sometimes dubious practices of trade or illegal breeding, animal trafficking, various frauds, etc. (Order of October 7, 2015). What could be simpler as a breeder than to assume responsibility if an illness or lack of conformity were to be detected after the sale and for which the breeder could not either ignore or be held responsible. Amicable research is always preferable to legal action in the American style, which can sometimes be difficult to bear and the outcome of which would be uncertain. The seller undertakes and limits his liability to the exclusion of any other unagreed expense to reimburse the entire price paid if the cat were to die or be affected by an illness and returned to the seller or reimburse part of the price, however limited to 50% if kept as is by the buyer. Furthermore, the buyer can return the cat to the seller within 6 months of its birth if it does not suit the buyer for 30% of its price excluding tax on the day of delivery provided that its condition is not not altered or transformed (all supporting tests) and if spayed/neutered since then, deduct €200 from this sum. Following which the seller will remit to the buyer 50% of the added value excluding tax (Calculated on the price excluding deduction for sterilization/castration) in the event of reclassification to a third party and if effective within 6 months of the restitution to the seller.
List of documents given to the buyer:
- Copy of negative tests for communicable diseases from the Fiv Felv cattery.
- Copy of the pedigree of the parents and their negative HCM PKD tests. Veterinary certificate of good health for the kitten.
- Reminder of the purchaser's commitments to keep the animal in conditions compatible with its biological and behavioral needs and to give it the necessary care.
- Photograph of the kitten and mention of the observations noted by the parties during delivery.
- The non-exhaustive list of legal guarantees and remedies.
- The extract from the ordinance of October 7, 2015 relating to the trade in domestic animals.
- The vaccination record stating the vaccines on the day of delivery. (European passport for export with the rabies vaccine).
- Copy of the temporary identification card (I-CAD)
- A kitten kit to ensure the transition.
